Contract 

Puppy Sales Contract - Robertson Kennels

This Puppy Sales Contract ("Contract") is made and entered into this ____ day of ____________, 20____, by and between Robertson Kennels, a hobby breeder with a principal place of business in Tacoma, Washington ("Breeder"), and _______________________________, residing at _______________________________ ("Buyer").

WHEREAS, Breeder is engaged in the breeding of Australian Shepherds; and

WHEREAS, Buyer desires to purchase a puppy from Breeder.

NOW, THEREFORE, in consideration of the foregoing premises and the mutual covenants contained herein, the parties agree as follows:  

1. Sale of Puppy: Breeder agrees to sell and Buyer agrees to purchase one (1) puppy (the "Puppy") born on _______________, with the following description:

  • Gender: _______________

  • Breed: ___________________

  • Coat Color: _______________

  • Eye Color: _______________

  • Registration: Eligible for registration with _______________ (ASDR/AKC/DKC) (circle applicable registry)

2. Purchase Price and Payment: The purchase price of the Puppy is $_________ [AMOUNT] (the "Purchase Price"), which Buyer has paid to Breeder as follows: _______________ [DESCRIBE PAYMENT METHOD].

3. Health of Puppy:

(a) Breeder Representations: Breeder represents and warrants that:

  • To the best of Breeder's knowledge, the Puppy is in good health and free from genetic defects at the time of sale.

  • The Puppy has received its first set of vaccinations and deworming medication in accordance with a veterinarian's recommended schedule.

  • All other animals residing at Breeder's premises are regularly examined by a veterinarian and are up-to-date on vaccinations and parasite control medications.

(b) Buyer's Veterinary Examination: Buyer agrees to have the Puppy examined by a licensed veterinarian within seventy-two (72) hours of taking possession of the Puppy. If the veterinarian determines that the Puppy is ill or has any genetic defects, excluding parasites common to the area, Buyer may return the Puppy to Breeder within 2 days of the veterinary examination for a full refund of the Purchase Price.

(c) Disclaimer: Breeder is not a licensed veterinarian and makes no guarantees regarding the future health of the Puppy. Buyer acknowledges that the Puppy is a living animal and that its health is subject to various factors, including its environment and care. Breeder shall not be liable for any future veterinary expenses or costs associated with the Puppy's upkeep.

4. Registration and Kennel Name:

(a) Registration: Upon proof of spay/neuter (if applicable), Buyer will receive registration papers for the Puppy from the applicable registry.

(b) Kennel Name: All puppies produced by Robertson Kennels shall have the prefix "Robertson Kennels" or "RK" before their registered name. In accordance with registry guidelines and this Contract, the kennel name MUST be used as a prefix in the Puppy's registered name. Failure to do so may result in termination of papers, and/or fines.

5. Spay/Neuter Agreement:

  • [ ] Spay/Neuter Contract: The Puppy is sold on a spay/neuter contract. Buyer agrees to have the Puppy spayed or neutered by a licensed veterinarian within one (1) year of purchase. Failure to comply with this provision will result in:

    • Termination of Buyer's ownership of the Puppy and any offspring.

    • Forfeiture of any offspring of the Puppy to Breeder.

    • Buyer's responsibility for all legal fees incurred by Breeder in enforcing this provision.

    • A fine of $1,000.00 payable to Breeder.

  • [ ] Full Breeding Rights: The Puppy is sold with full breeding rights.

6. Return of Puppy: If, for any reason, Buyer is unable to keep the Puppy, Buyer agrees to return the Puppy to Breeder for rehoming or to contact Breeder for assistance in finding a suitable new home. Buyer agrees not to surrender the Puppy to a shelter or humane society.

7. Disclaimer of Guarantees: Breeder makes no guarantees regarding the temperament, trainability, or show potential of the Puppy.

8. Limitation of Liability:

(a) Health and DNA Testing: Buyer acknowledges that health and DNA testing through companies such as Embark, PawPrint Genetics, and Wisdom are not always 100% accurate and are primarily for informational purposes.

(b) Defamation and Slander: Buyer agrees that any slander, defamation, or libel against Breeder or its owners will be pursued in court, and Buyer will be liable for fines of at least $2,500.00.

9. Entire Agreement: This Contract constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.  

10. Governing Law: This Contract shall be governed by and construed in accordance with the laws of the State of Washington.

11. Severability: If any provision of this Contract is held to be invalid or unenforceable, such provision shall be struck from this Contract and the remaining provisions shall remain in full force and effect.  

12. Notices: All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered personally, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

or to such other address as either party may designate in writing from time to time.

13. Binding Effect: This Contract shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors, and permitted assigns.
